Sammy El Jamal, a gas station owner and entrepreneur, filed a lawsuit in U.S. District Court this week claiming that Dunkin’ Donuts breached the terms of a franchise agreement the two parties reached in 2010.
The lawsuit alleges that Dunkin’ Donuts forced El Jamal to “purchase unusable equipment and unusable space; misrepresenting critical aspects of the franchise agreement; forcing (him) to purchase its baked goods from one of Dunkin’s preferred vendors rather than baking them internally with the ‘Just Baked on Demand’ baking system that Dunkin insisted (El Jamal) purchase, leading to … significant expense and determinant.”
El Jamal alleges that Dunkin’ Donuts later allowed an underlying lease with the Westchester County Airport to lapse without support. In total, he alleges his business interests incurred monetary damages believed to be in excess of $10 million.
